Trump’s pardons and commutations, as broad as they were, offer Ball no protection here for these gun charges stemming from a separate indictment. Similarly, any new crimes committed by other Jan. 6 rioters would result in new charges and arrests, and they would have no shield from prosecution.
Considering how a number of the rioters were turned into authorities by their families, friends, or coworkers, it is possible we may see other charges brought against these former convicts and defendants if they seek retribution. Most of those charges would fall under state criminal codes (assault, stalking, harassment, and so on), and would therefore be beyond the power of the president to pardon.
