Sens. John Fetterman (D-Pa.) and Kevin Cramer (R-N.D.) introduced the *Payment Choice Act* this week, a bipartisan measure that would compel most retail businesses to accept cash for in-person transactions of $500 or less.
“If you’re open for business in America, you should take U.S. dollars,” Fetterman said in a press release <www.fetterman.senate.gov/fetterman-cramer-introduce-bipartisan-bill-to-preserve-payment-choice/>. “We have millions of people in this country who don’t have access to bank accounts, and they must be able to go shopping with their hard-earned dollars.”
Under the proposed legislation <www.fetterman.senate.gov/wp-content/uploads/2025/07/Payment-Choice-Act-2025.pdf>, businesses that accept in-person payments would be required to take cash—defined as U.S. currency—in amounts up to and including $500. The bill includes limited exceptions, such as when a business lacks change or experiences a system failure, and it allows the use of a cash-to-card machine provided it does not charge fees.
“Forcing the use of credit and debit cards or imposing premium prices on goods and services paid for with cash limits consumer choice,” Cramer said. “Americans should have the option of using cards or cash, but they should be the ones who make that choice.”
The legislation would also prohibit businesses from being forced to accept higher denominations—$50 bills or larger—for the first five years. After that period, the Secretary of the Treasury would determine future requirements, but must ensure acceptance of $1, $5, $10, and $20 bills.
The measure comes as lawmakers on both sides of the aisle express growing concerns about the rise of cashless retail models and the implications of centralized digital payment systems. Troy Downing (R-Mont.) have warned that Central Bank Digital Currencies (CBDCs) “border on Orwellian” and represent a potential threat to consumer privacy.
Fetterman and Cramer’s legislation seeks to guarantee the continued viability of physical currency in everyday commerce and prevent Americans—particularly the unbanked—from being left behind in a cashless economy.
